Jurisdictional wetland
A wetland that falls under federal Clean Water Act authority, and therefore under permitting requirements.
Whether a given wetland is jurisdictional has been the subject of repeated and shifting federal rulemaking and litigation, and the boundary of federal authority has moved more than once in recent years.
National Wetlands Inventory mapping is the standard screening source, but it is a mapping product rather than a legal determination. A formal delineation is what establishes jurisdiction on a specific parcel.
